Noemion — Privacy Policy
Last updated: 9 October 2026
1. Who we are
Noemion is an AI customer-service assistant for Shopify stores. It is provided by NOT SO COMMON LTD, trading as The Tryon Company ("we", "us"), a company registered in England and Wales under company number 17504170, with its registered office at Office 21814, 182-184 High Street North, East Ham, London, E6 2JA, United Kingdom.
For any question about this policy, or to use your rights: support@thetryoncompany.com.
2. Our two roles
- Shopper data (people who chat with a store that uses Noemion): the store is the controller and we are its processor. We act on the store's instructions under our Data Processing Agreement, apart from the purposes we name as our own in §3. If you are a shopper, the store you contacted decides what happens to your conversation, and your requests go to the store first (§10).
- Merchant and staff data (the merchant, and the store's staff who use Noemion): we are the controller (§6).
Replies and notes the store's staff write in a conversation are part of that conversation, and are shopper data.
3. What we process about shoppers, and why
| What | Where it comes from | Why |
|---|---|---|
| The conversation: your messages, and the replies of the assistant and the store's staff | You, and the store's staff | To answer your question, and to give the store's team the history when a person takes over |
| A random session identifier | Created in your browser when you open the chat or start typing | To reconnect you to your own conversation |
| Your IP address (for IPv6, its network prefix) | Your browser's requests | To limit how many requests one address can send, so the service cannot be flooded. Our hosting and network providers (§7) also handle it to route and protect traffic |
| Your name, email address and, if you give one, an order number | The "talk to a person" form, or an email you send the store | To pass your request to the store's team and reply to you, including by emailing you a copy of the conversation when the team has replied after you left (unless the store has switched this off) |
| Your email address and an order number, typed in the chat | You | To check that an order is yours: its details are shown only after the order number and email address match |
| Order details: status, dates, items and delivery tracking; and, in the store's staff workspace, the delivery address and phone number and the store's customer names and email addresses | The store's Shopify store | To answer questions about an order, and to let the store's staff handle it |
| Ratings (thumbs up or down) of the assistant's answers or the team's help | You | To show the store how well it is helping you |
| Emails you send the store, if it forwards its support inbox to Noemion: your name, email address, the subject and your latest message | You | So the store's team can answer you |
| Whether you are still connected and typing (never what you type) | Your browser | So the store's team can see you are there, and so the conversation can close after you leave |
| Operational records: timestamps, counts, which automated steps ran, request identifiers and error reports | The service | To run, bill, secure and fix the service |
Talk to a person. When you send a "talk to a person" request, your name and email address are also added to the store's Shopify customer list, tagged "Noemion chat", with no marketing consent. The email you type only to check an order is not added.
Lawful basis. For shopper data the store, as controller, decides the lawful basis, typically the performance of its contract with you or its legitimate interest in answering customer enquiries. We use shopper data as a controller for our own purposes only to protect the service from abuse, to bill stores, to diagnose faults and measure running costs, to check from counts and outcomes (never from message content) that the service works as intended, and to meet our legal obligations, including keeping proof that a privacy request was carried out. For these we rely on our legitimate interests, or on the legal obligation itself. We never use shopper data for advertising or to train or improve an AI model.
4. The assistant is an AI
The assistant's replies are generated by an AI model, not written by a person. Every chat begins with the notice "You're chatting with an AI assistant. Ask anytime to talk to a person."
5. What your browser stores
The chat stores the items below in your browser. It uses no cookies. All of them are strictly necessary for the chat to work, and none is used for advertising, analytics or tracking.
| Name | Type | What it is for | How long it lasts |
|---|---|---|---|
noemion_handshake | Session storage | A 30-minute pass for this store's chat, and the chat's settings. Written when a page with the chat loads; holds nothing about you | Until you close the tab |
noemion_disabled_session | Session storage | Marks that the chat could not start in this tab | Until you close the tab |
noemion_panel_open | Session storage | Keeps the chat window open as you move between pages | Until you close the tab |
noemion_conv_active | Session storage | Keeps a conversation receiving replies as you move between pages | Until the conversation ends or you close the tab |
noemion_session_id | Local storage | The random identifier that reconnects you to your conversation. Created only when you open the chat or start typing | Removed after 12 months without using the chat, or when you clear your browser storage |
noemion_session_seen | Local storage | When you last used the chat, so the identifier above can be removed after 12 months | As long as the identifier above |
6. What we process about merchants and staff, and why
| What | Where we get it | Why | Lawful basis |
|---|---|---|---|
| Store details: domain, Shopify shop identifier, name, time zone and contact email; plan and billing status; an encrypted Shopify access token | Shopify, at install and daily | To connect to the store, provide the service, bill, and send service and security notices | Contract; legitimate interests (notices) |
| Staff name and email address | The person who invites you, or you | To create your account, sign you in, and show who replied | Contract, where you are the merchant; otherwise legitimate interests (providing the service your organisation asked for) |
| Store-owner check: your Shopify user ID, name and email, and whether Shopify marks you as the owner | Shopify, when you claim the workspace | To confirm you own the store before giving you control of its workspace | Legitimate interests |
| Sign-in and security records: sessions, IP address, browser, timestamps, sign-in attempts | Your browser | To keep accounts secure and detect abuse | Legitimate interests |
| Role, permissions, availability and reply signature | You, your team's admins, your activity | To control who can do what, route chats, and show shoppers who is helping | Contract; legitimate interests |
| Workspace activity, including which conversations and orders you view | Your use of the workspace | To provide the service and keep an audit trail | Legitimate interests |
| A connected mailbox address and an encrypted, send-only authorisation | You | To send replies from your own address | Contract; legitimate interests |
| Drafts you send to "Improve", with the store's style guidelines | You | To suggest a rewrite through our AI provider. Not stored | Legitimate interests |
| Feedback you send us, with your name, email, the page and browser details | You | To answer and fix what you report | Legitimate interests |
| API keys (stored hashed), who created them and when each was last used | You | To let the store read its conversations by API | Contract |
| Usage and billing records | Shopify billing; the service | To bill correctly, and to give the first-month bonus once | Contract; legal obligation (accounting records) |
| Analytics events and error reports, keyed to the store | The service | To keep the service reliable and find faults | Legitimate interests |
Your display name is shown to your teammates and to the shoppers you help, is included in the store's conversations API, and is added to the store's Shopify order timeline when you cancel or edit an order. The staff workspace uses a strictly necessary sign-in cookie, and keeps your preferences, recent searches, unsent replies and a key that stops a refund being issued twice in your browser's storage.
You are not legally required to give us any of this data, but we cannot provide the service, or a feature you choose to use, without the data it needs.
7. Who else processes the data
We disclose personal data only to the store a shopper contacted, to the providers below, where the law requires it, to protect people's safety or our legal rights, to our professional advisers, or to a buyer of our business who continues to protect it as this policy describes.
| Provider | What for | Where |
|---|---|---|
| OpenAI (OpenAI OpCo, LLC) | Production AI provider: writes the assistant's replies from the conversation, the order details it looks up, the store's catalogue, knowledge base and settings, and rewrites staff drafts sent to "Improve" | United States |
| xAI (SpaceXAI LLC) | Backup AI provider, used only if we switch to it: the same | United States |
| Resend (Plus Five Five, Inc.) | Sends and receives email: replies to shoppers, notices to the store's team (with the conversation), sign-in codes, invitations and alerts to staff, staff feedback forwarded to us, and emails a store forwards to Noemion | United States |
| Render (Render Services, Inc.), with Cloudflare as its network edge | Hosting: servers, database and backups, and logs. Cloudflare carries every request, including the IP address | Render: Frankfurt, Germany. Cloudflare: global |
| PostHog (PostHog, Inc.) | Analytics and error monitoring. Events can carry random conversation, chat-session and request numbers and a store's order number; never message text, names, email addresses or phone numbers | European Union |
| Microsoft 365 (Outlook) | Our business mailbox: messages you send to the address in §1 | United Kingdom |
| Proton (Proton AG) | The inbox for feedback staff send from the workspace | Switzerland, Germany or Norway |
Neither AI provider may train AI models on the data. OpenAI may keep requests and responses for up to 30 days to detect abuse; the backup is used only under zero data retention. The first five providers are the subprocessors listed in our Data Processing Agreement.
If a store connects its own Google or Microsoft mailbox, replies are sent through it under the store's own agreement with that provider.
8. International transfers
We are in the UK, and our hosting and analytics are in the European Union; transfers between the UK and the EEA or Switzerland rely on adequacy. For providers in the United States we rely on the EU–US Data Privacy Framework and its UK Extension where the provider is certified, and otherwise on the European Commission's Standard Contractual Clauses in each provider's data processing terms, with the UK Addendum where those terms provide it. You can ask us for a copy of these safeguards at the address in §1.
9. How long we keep data
Unless a row says otherwise, retention is applied automatically. We may keep specific data longer where the law requires it or to establish, exercise or defend a legal claim.
| What | Kept for |
|---|---|
| Conversations, messages, the name and email attached to them, and "talk to a person" requests | 12 months from the conversation's start (a request: from the day it was made) |
| Satisfaction ratings (no name, email or message content) | Until the store's data is erased; made anonymous when a shopper's erasure request finds their conversation |
| Support-access records (who viewed which conversation or order) | 24 months |
| Refund records (order details and amounts, no names or contact details) | 24 months (a refund in progress until it settles), or until the store's data is erased, if sooner |
| Records of privacy requests received through Shopify (request type, store, Shopify's customer ID, a keyed hash of the email address, dates) | 6 years, as proof the request was carried out |
| Notifications from Shopify about a store | 90 days, or until the store's data is erased, if sooner |
| Billing records | 6 years, as accounting and tax law requires; the fact that a store has had a plan is also kept, so the first-month bonus is given once |
| Records of each AI call (model, amount of text, timing and cost; never message text) | Until the store's data is erased |
| Staff accounts | While the account is active; a removed staff member's name and email stay with what they did for as long as the store's records of it are kept |
| Staff sign-in sessions | 90 days after the session ends |
| One-time sign-in codes; sign-in rate-limit records | Until the code lapses (five minutes); a day after last use |
| Staff feedback | 24 months |
| Emails in our business mailbox (Microsoft 365) and our staff-feedback inbox (Proton) | 24 months, then deleted |
| Staff notifications | 12 months |
| Rate-limit counters (including IP addresses) | Up to one hour |
| Server logs | Up to 14 days |
| Analytics events and error reports | One year |
| Email content held by Resend | 30 days |
| Backups | Deleted data can remain in backups for up to 7 days |
| After a store uninstalls Noemion | Its Shopify access tokens are deleted at once, and its data is erased when Shopify asks us to, 48 hours after the uninstall, apart from the billing and privacy-request records above |
The name and email a "talk to a person" request adds to the store's Shopify customer list are the store's own record, and we do not delete them.
10. Your rights
Data protection law gives you the right to access your personal data, to have it corrected or erased, to restrict its use, to data portability, and to object to processing based on legitimate interests.
Your right to object. Where we rely on legitimate interests, you can object at any time, and we will stop unless we have compelling legitimate grounds or need the data for a legal claim.
- Shoppers: contact the store you chatted with, which is the controller. If you contact us instead, we will pass your request to the store and help it respond.
- Merchants and staff: contact us at support@thetryoncompany.com. We respond within one month, and may need to confirm your identity first.
Erasure of shopper data. When a shopper's erasure request reaches us through Shopify, we delete their conversations' messages, staff messages included. We keep:
- each conversation's record (timestamps, counts, the store's tags and assignment), no longer linked to the shopper's browser, until its 12-month limit;
- the conversation's ratings, no longer linked to the shopper's browser, until the store's data is erased (§9);
- the store's records of staff activity on the shopper's orders, with the order numbers removed;
- the order number in two cases: a refund still in progress, until that refund record is deleted (§9); and a support-access record of an order that is neither linked to one of the shopper's conversations nor named in a refund or order-change record we still hold (an order change's record goes with its conversation at 12 months), until that record's 24-month limit;
- the record that the request was carried out.
We find a shopper's conversations by the email address linked to them through an email, a "talk to a person" request or an order check. A conversation in which an address was only typed is not found, and is deleted at 12 months.
Complaints. You can complain to us at the address above, and to the UK Information Commissioner's Office (ico.org.uk), or in the EU to the data protection authority where you live or work.
11. Security
Each store's data is kept separate, data is encrypted in transit and Shopify and mailbox credentials at rest, access is limited by role, and staff views of shopper conversations and orders are logged.
12. Changes to this policy
We post changes on this page and update the "Last updated" date. Before a material change takes effect, we tell merchants in the app or by email.
